Constitutional Basis for an "Alternative Government"
We were all caught up with the PRD´s actions at the Congress, which impeded President Fox from speaking. However, other things happened that day that perhaps we should have paid more attention. Andres Manuel Lopez Obrador at his Friday rally asked his followers not to march to the presidential palace. He also talked about the upcoming “Democratic Convention” that his followers are organizing for September 16th. During this rally he stated that "Vamos a la Convención, porque vamos a tener un gobierno de la República. ¡Que se vayan al diablo sus instituciones! " (We are going to have the Convention because we will have a Republican government. Their institutions can go to hell!) Now how should we interpret this comment? This is probably one of the most disturbing comments made by AMLO up until now..
Anyway, AMLO uses Constitutional Article 39 to justify the Democratic Convention and the creation of an alternative government. This article states: “National sovereignty is vested essentially and originally in the people. All public power derives from the people and is instituted for their benefit. The people have at all times the inalienable right to alter or amend their form of government.” I guess AMLO believes that he is “the people”… Also he is ignoring the following article 40 that states the “The people exercise their sovereignty through the Powers of the Union, in the case under their jurisdiction, and through the Powers of the States concerning their internal regimes, in the terms respectively established by this Federal Constitution and the particular constitutions of the States, which may never contravene the provisions of the Federal Pact…..” It sounds like there is much more then just declaring yourself the "people"....

Oops! Did I miss something? Isn't the turmoil in Mexico due to election fraud? Or, supposed fraud? Nonetheless, it seems that a lot of PEOPLE of Mexico are certainly upset with the way the election was conducted. I think we're talking PEOPLE here aren't we? I mean it's not like one person is protesting, is it? --- Ok, edit this comment out, but I think you know what I'm trying to get at.
